Service infrastructures of other operators

                           The inquiring rail traffic operator makes a request (including their identification data, essential details on the access requested,
                           other information relevant in order to plan and provide of operations and a declaration / statement to observe the terminal’s
                           own technical operational rules and the applicable norms and regulations). Based on the request a Contract / convention is
                           executed for the access to the railway infrastructure and associated services – with a variable duration depending on the
                           parties negotiations, after which the operation license for the industrial line is modified – 30 days legal term for AFER to solve
                           the request.
                             There is no type-model for the access request to the service infrastructures and its supplied services
6.2   Reply to requests   Requests to access the service infrastructures will be solved, in the order of their arrival, within 5 working days, a term for
                          Unicom Holding SA – the service infrastructure operator to reply to requests to access / service provision on the service
                          infrastructures in Dornesti Terminal / working point.
                          Coordonation procedure:

1.Analysis and assessment of requests

• • requests are analyzed in order of arrival and depending on the limit of available capacities.
• • In case of multiple requests for the same period, Unicom Holding SA initiates negotiations with all applicants to identify

optimal solutions and/or alternatives to distribute the capacities.

• • Any amendment of the rights of access already given to an applicant is subject to the applicant’s approval.
• • Potential solutions may include:
• - resqueduling of access depending on the availability;
• - sharing the capacity by distribution on strict time intervals;
• - alternative use of the available service infrastructure.

2.Priority criteria: The priority criteria applicable for the distribution of the capacity in case of concurrent access requests to industrial railways are: a. already existing contracts for the use of industrial railways of Unicom Holding SA; b. efficiency of infrastructure use:

• • the intent and possibility to use the requested capacity (failure to completely use, in the past, a given capacity and

reasons for that may influence the priority criteria);

• • minimizing the stay times – the requests with shorter stay times will be prioritized over those blocking the

infrastructure for longer periods. c. time squedule and compatibility of operations:

• • correlation with the squedule of the terminal and of associated infrastructure operators (CFR SA, GFR SA) – to avoid

congestions and optimize the transit between infrastructures. d. tehnical characteristics of the convoy:

• • compliance with the operational rules – requests consistent with the technical and operational requirements may be
