icom-group.ro; The RTO (rail transport operator) makes a request (including their identification data, essential details on the requested access, other informaton relevant in order to plan and provide the operations and a statement / undertaking to observe the terminal’s own technical operation rules for the industral railways and applicable norms and regulations); based on this request an access Contract is executed for the access to the railway infrastructure and associated services – with a variable duration depending on the parties negotiations, after which the operation license for the industrial line is modified – 30 days legal term for AFER to solve the request. There is no type-model for the request to access the service infrastructures, and the services supplied 6.2 Reply to requests Requests to access the service infrastructures will be solved, in the order of their arrival, within 5 working days, a term for Unicom Holding SA – the service infrastructure operator to reply to requests to access / service provision on the service infrastructures in Dornesti Terminal / working point. Coordonation procedure: 1.Analysis and assessment of requests • requests are analyzed in order of arrival and depending on the limit of available capacities. • In case of multiple requests for the same period, Unicom Holding SA initiates negotiations with all applicants to identify optimal solutions and/or alternatives to distribute the capacities. • Any amendment of the rights of access already given to an applicant is subject to the applicant’s approval. • Potential solutions may include: - resqueduling of access depending on the availability; Compania Naţională de Căi Ferate “CFR” S.A. România - sharing the capacity by distribution on strict time intervals; - alternative use of the available service infrastructure. 2.Priority criteria: The priority criteria applicable for the distribution of the capacity in case of concurrent access requests to industrial railways are: a. already existing contracts for the use of industrial railways of Unicom Holding SA; b. efficiency of infrastructure use: • the intent and possibility to use the requested capacity (failure to completely use, in the past, a given capacity and reasons for that may influence the priority criteria); • minimizing the stay times – the requests with shorter stay times will be prioritized over those blocking the infrastructure for longer periods. c. time squedule and compatibility of operations: • correlation with the squedule of the terminal and of associated infrastructure operators (CFR SA, GFR SA) – to avoid congestions and optimize the transit between infrastructures. d. tehnical characteristics of the convoy: • compliance with the operational rules – requests consistent with the technical and operational requirements may be prioritised over those needing additional adjustments. e. timely communication of requests f. chronological order of requests on a first-come first-serve basis, when there are no stronger priority criteria. These criteria are transparent and non-discriminatory, under the european and national rules on acces to railway service infrastructures property of Unicom Holding SA. 3.Disputes settlement between the parties • if the parties fail to reach an agreement, Unicom Holding SA has the final decision based on the principles of operational efficiency and optimal use of available resources. • in case of misunderstandings, applicants may file complaints according to law. 4.Reply to requests • the decisions on the distribution of capacities will be notified to applicants using the contact details mentioned in the filed requests. • in case of denial of access, the decision will be justified in a written notification including the objective reasons of the denial, and, if possible, any available alternative solutions. 6.3 Available capacities and According to the Regulations on the way to perform the railway transport/ shunting activity on the industrial lines, there are temporary restrictions no temporary restrictions of the operation of the services infrastructures, may appear accidentally / occasionally. The work capacities intended for the freight handling and storage services will be agreed with each client individually depending on the available resources and free storage areas. Charges Compania Naţională de Căi Ferate “CFR” S.A. România 4.1 Information on charges Service charges are set by the rail transport operator Unicom Tranzit SA operating the Halmeu terminal. Access charge on the industrial rails of Halmeu working point is maximum 6.09 lei/convoy/ passing. Tariff applis regardless of the number and type of rail vehicles composing the convoy or of an isolated locomotive. Prices for the handling and storage services provided within the service infrastructure are defined equally for each asking customer depending on the type of service, its duration and necessary resources and are calculated in lei/ton or euro/ton. Access and fuel supply fees are included in the price of contracts concluded by Unicom Holding with its customers / the beneficiaries of the freight terminal services. We do not charge fees for services related to fuel supply. The fuel price is variable and is mutually agreed upon by the parties through buyer orders confirmed by the seller Unicom Holding SA; it is updated daily based on fuel price trends on the national and international markets, exchange rate fluctuations, or official changes made by domestic producers via official notices or websites. Furthermore, increases resulting from normative acts affecting sale price components (e.g., excise duty level, VAT, etc.) shall modify the sale price accordingly and be reflected in the fuel price level, becoming mandatory for the parties as of the effective date of said normative acts.For the access on the industrial rails of Halmeu working point is also charged the usage fee for transit industrial rails for rail transport operators transiting the lines. 4.2 Information on discounts there is no discount policy applied to tariffs for the access on the industrial railways. 5. Access Conditions 5.1 Legal conditions Based on a contract access convention negotiated with the clients, to specify the general terms and conditions to ensure access to the supply of service infrastructure with necessary conditions 5.2 Technical conditions Industrial normal gauge line of 1435 mm, non-electrified, connected indirectly to the CFR Halmeu station, by the transit line property of CNMPN REMIN SA Baia Mare and operated by SC Unicom Tranzit SA : - maximum axle load 20.5 tons; - maximum admitted tonnage per convoy 860 tons; - maximum admitted length of convoy 225 m; maximum shunting speed 10 km/h; Industrial wide gauge line of 1520 mm, non-electrified connected indirectly to the CFR Halmeu station, by the industrial access line LFI 42L from UJ turnover 48 until the stopper and turnover no. 6UT: - maximum axle load 25 tons; - maximum admitted tonnage per convoy 700 tons; - maximum admitted length per convoy 120 m. – maximum shunting speed 10 km/h. Towing system : diesel, maximum shunting speed 10 km/h. Technical conditions allowing the operation of the industrial rails to be observed for the use of the service infrastructure (industrial rails for the access of the freight cars convoys to the unloading / loading fronts / transshipment ) are provided in the Operation License series AE no. 409-R3 of the rail transport operator Unicom Tranzit SA, technical conditions Annex A and Regulations for the way to perform the shunting activity on the industrial rail of UNICOM TRANZIT SA – Halmeu working point and according to technical operation rules of UNICOM TRANZIT SA – Halmeu working point . 5.3 Self-supply of rail-related No services 5.4 IT systems No 6.
