Preliminary assessment of the second payment request of Romania

   i)   Cover note duly justifying how the milestone (including all the constitutive elements) was
        satisfactorily fulfilled;
  ii)   Copy of the Government Ordinance No. 14 of 13 July 2022 amending and complementing
        Law No. 95/2006 on the reform in the health sector, published in the Official Journal No.
        711 on 15 July 2022;
 iii)   Copy of the Government Ordinance No. 37 of 31 August 2022 amending and
        complementing Law No. 95/2006 on the reform in the health sector and Law No. 227/2015
        on the Fiscal Code, as well as establishing some other measures in the health sector,
        published in the Official Journal No. 857 on 31 August 2022;
 iv)    Copy of the Government Emergency Ordinance No. 129 of 29 September 2022 amending
        Article IV of Government Emergency Ordinance No. 44/2022 on establishing some
        measures within the health system, as well as for the interpretation, modification and

        complementing some legal acts, for the prolongation of some deadlines, and for
        establishing some measures in the health sector, published in the Official Journal No. 954
        on 30 September 2022;
  v)    Copy of the Government Decision No. 1183 of 29 September 2022 on the organisation and
        functioning of the National Institute for Health Services Management (hereinafter also
        referred to as “INMSS”), published in the Official Journal No. 961 on 3 October 2022;
 vi)    Copy of the Government Decision No. 1184 of 29 September 2022 on the modification of
        annex 2 of Government Decision No. 144/2010 on the organisation and functioning of the
        Ministry of Health, published in the Official Journal No. 961 on 3 October 2022;
 vii)   Copy of the Ministerial Order No. 3143 of 7 October 2022 on the establishment of the
        quality evaluation criteria for the endorsement of upskilling courses in health management
        or health services management, published in the Official Journal No. 983 on 10 October

        2022.
viii)   Copy of Government Decision 1236 of 12 October 2022, approving the Memorandum of
        Understanding between the World Health Organisation and the Romanian Ministry of
        Health as the main grant beneficiary of the National Recovery and Resilience Plan for
        Romania, signed in Bucharest and Copenhagen on 10 June 2022, of Amendment No 1 to the
        Memorandum of Understanding signed in Bucharest and Copenhagen on 1 August 2022,
        and of Amendment No 2 to the Memorandum of Understanding signed in Bucharest and
        Copenhagen on 22 September 2022, published in the Official Journal No. 1035 on 25
        October 2022.

The authorities also provided:
 ix)   Copy of Decision No. 12 of 29 June 2018 of the College of Doctors of Romania on the
       regulation of the national system of continuous medical education, of the criteria and rules
       for the accreditation of providers of continuing medical education, and of the procedural
       system for the evaluation and crediting of continuous medical education activities
       addressed to doctors, published in the Official Journal No. 683 on 6 August 2018;
  x)   Collaboration Protocol No. 16679 of 22 September 2022 between the Ministry of Health
       and G6-UMF University Alliance Association.

Analysis:

The justification and substantiating evidence provided by the Romanian authorities covers all constitutive elements of the milestone.

The amendments target the main law governing the health sector (Law No. 95 of 2006, as amended) On 15 July 2022, Government Ordinance No. 14 of 13 July 2022 amending and complementing Law

45
